SCOTUS Turns New York Law Into A National Win

Full disclosure I am also not a BAR certified lawyer, but I do know and understand an unreasonable amount of law. What I am saying is if I misspeak or get something wrong, I will correct it if I become aware of it. This is a simplified explanation and is not meant to twist words or present propaganda.

First lets talk about the historical overturn of a law that has been in place for over 100 years. In New York, and every other state, there has been unconstitutional laws on the books that disregard the 2nd amendment. This case is about New York, limiting access to concealed carry permits. I know, we’re still pretending that we “need” a permit to observe our rights… small steps. These laws were challenged in New York, and finally presented to the Supreme Court.

What happened was, not only was that case solved, it blew the doors off for all these other states with similar laws. We’re lookin at you California. There are multiple (6) states that “may” issue a concealed carry permit. In reality these states require such a degree of “proof of necessity” that endangered domestic violence victims, and other constitutionally allowed citizens are left to be murdered, defenseless. The state simply says “no” when presented with the application for a permit. Applications from victims of domestic violence, single mothers in sketchy neighborhoods, lawyers, businessmen, and other legally eligible citizens. The state doesn’t care, they hate guns so much they’d prefer to watch innocent lives lost than allow a legal firearm be carried. Meanwhile make zero effort to disarm the criminals.

This new ruling ended that. Basically it said there is no “may” anymore. Instead it is now “shall”. That’s right, it turns out if you leave your home, you’re still a citizen. I know, but apparently places like California, New York, Hawaii, etc… don’t agree. According to them your constitutional rights end at your front door. Curious if that also applies to things like freedom of speech, due process, freedom from unlawful search, etc… Are you only safe in your home? What if you don’t own the home? What about a rental? Thankfully the SCOTUS is smarter than your average politician. They said, and I unsurprisingly agree, your rights follow you outside.

Now before we celebrate too much, there are some errors. There are also unconstitutional laws passed this week that violate the 1st, 2nd, and 4th amendment you can check out here. The biggest error I’ve found, so far, in this bill is words like “sensitive places”. I’m assuming the court means the typical places like courthouses, and government buildings. We all know what these slimy lawyers will do with that though. Suddenly everything becomes sensitive. The subway is sensitive, so is the bus. Grocery stores and city parks, etc…

Why Is It A Big Deal?

They are going to try and label everything as a sensitive place. Therefore legally allowing you to obtain a permit, but making it illegal to carry anywhere. The results are nobody can carry, making everyone just as defenseless as before, and resulting is the deaths of innocent citizens. Which, end game, will result in them asking for more gun control. The Court does outline this concern with basically a “don’t do that.” So yeah, we’ll see.

There were also other smaller “wins” as well such as reiterating that the second amendment does not only apply to firearms of the 18th century. The 2nd also pertains to modern firearms, and yes future firearms. It also puts in to official record the amount of verified self defense cases, and verifies our right to self defense with any firearm yet again. This is a huge win for the 2nd Amendment, but there is still plenty of fights to go.
